Subject: 10123/City Code/7-90/Presence of Humane Society @ Shows Date: Fri, 18 Aug 1989 14:54:00 -0500 ORDINANCE NO. 10123 AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, PART II, CHAPTER 7, BY ADDING A NEW SECTION 7-90 RELATIVE TO THE DUTY TO REPORT SHOWS AND ENTERTAINMENT INVOLVING LIVE ANIMALS TO HUMANE SOCIETY AND THE PRESENCE OF HUMANE SOCIETY OFFICER AT SHOWS INVOLVING LIVE ANIMALS. _________________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, that Chattanooga City Code, Part II, Chapter 7, be and the same is hereby amended by adding a new section 7-90 as follows: Sec. 7-90. Duty to report shows and entertainment involving live animals to Humane Society; presence of Humane Society Officer at shows involving animals; penalty for violation. (a) The owner of any auditorium, theater or other facility open to the public in which any person or other entity intends to have a show or other entertainment involving live animals shall notify in writing the Humane Educational Society of the City of Chattanooga, Tennessee of such intent not less than seven (7) calendar days in advance of such show or entertainment. (b) No owner of any auditorium, theater or other facility open to the public in which any person or other entity intends to have a show or other entertainment involving live animals shall permit or allow any such show or entertainment in the absence of an officer or employee of the Humane Educational Society of the City of Chattanooga, Tennessee, except as provided in subsection (c) below. (c) The Humane Educational Society of the City of Chattanooga, Tennessee, upon receiving such notice, shall have one or more of its officers or employees present at such show or other entertainment in order to ensure compliance with the provisions of this chapter, 0C provided that the Humane Educational Society of the City of Chattanooga, Tennessee may, in its discretion, elect not to attend such show or entertainment and shall notify the owner who has provided the aforesaid notification of such election in writing, and in such event no such owner shall be deemed to have violated the provisions of this section. (d) Failure to comply with the provisions of this section shall be punishable by a penalty of not more than Five Hundred Dollars ($500.00). SECTION 2. BE IT FURTHER ORDAINED, that this Ordinance shall take effect two (2) weeks from and after its passage as required by law.
